PURPOSE OF THE PRIVACY POLICY

The purpose of this policy is to provide you with all information relating to the processing of your personal data by the non-profit organization VISITWallonia (hereinafter referred to as "VISITWallonia") in the context of carrying out its public interest missions, as well as on the exercise of your rights.

VISITWallonia processes personal data (hereinafter referred to as "Personal Data") in accordance with Belgian and European regulations applicable to the protection of personal data, and notably:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as "GDPR");
  • The law of July 30, 2018 relating to the protection of natural persons with regard to the processing of personal data.

 

DEFINITIONS

  1. “personal data”:  Any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person; 
  2. “processing”: Any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;  
  3. “controller”: The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data ;  
  4. “processor”: A natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;  
  5. “recipient”: A natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not ;  
  6. “third party”: A natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data;  
  7. “consent”: Any freely given, specific, informed and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

CATEGORIES OF PERSONAL DATA PROCESSED BY VISITWALLONIA

VISITWallonia may process the following categories of Personal Data:

  • Identification data: name, first name, postal address, e-mail address, gender, date of birth, photo, spoken language ;
  • Professional data: title/position, employer's name, employer's address, country;
  • Browsing data processed when you visit our websites: IP address, data collected via cookies (see below), browsing history, browser type, pages viewed, unique identification numbers, geolocation data.
  • Data that you transmit spontaneously to VISITWallonia.

 

LAWFULNESS AND PURPOSES OF THE PROCESSING OF PERSONAL DATA

VISITWallonia is classified among the type 3 organizations referred to in the decree of December 15, 2011 organizing the budget, accounting, and reporting of Walloon public administration units, to which public interest missions are entrusted as defined in article 31/4.D. of the Walloon Tourism Code whose objective is to promote the heritage, infrastructures, and tourist initiatives of the French-speaking region.

It is within the framework of these missions entrusted to VISITWallonia that all processing of personal data takes place within VISITWallonia.

SHARING OF PERSONAL DATA

For the purposes described below, VISITWallonia may have to share your Personal Data with the following recipients:

i. Partners with whom VISITWallonia collaborates in the execution of its public interest missions:

  • all regional, federal, and community administrations and bodies in the exercise of their missions ;
  • any actor in the tourism, cultural, HoReCa (Hotel/Restaurant/Cafe), and professional associations sectors.

ii. VISITWallonia collaborators in Belgium and abroad in the exercise of their function.

iii. Subcontractors and external service providers.

VISITWallonia may have to disclose your Personal Data to comply with applicable laws, judicial orders, or injunctions from Courts and Tribunals, and/or protect and defend its rights or the rights of the persons concerned by the processing of these Personal Data. In each case, VISITWallonia ensures that this disclosure is following the law and preserves your fundamental rights related to data protection.

Your Personal Data is stored in Belgium or elsewhere in the European Economic Area, thus ensuring equivalent protection.

However, your Personal Data may be shared with recipients located outside the European Economic Area. In such cases, VISITWallonia makes every effort to ensure that these recipients guarantee adequate protection. This includes measures such as adequacy decisions by the European Commission, standard contractual clauses, binding corporate rules, or other mechanisms compliant with EU requirements.

 

WHAT ARE YOUR RIGHTS AND HOW TO EXERCISE THEM?

In accordance with current legislation, you have a number of rights relating to the processing of your Personal Data.

These rights can be exercised by sending a letter to VISITWallonia or an email to the following address: vieprivee@visitwallonia.be.

Right of access

You have the right to ask VISITWallonia for the Personal Data it holds about you. This right gives you the opportunity to request a copy of all or part of your Personal Data.

Right to object

When the processing of your Personal Data is based exclusively on the execution of one of VISITWallonia’s public interest missions, you have the right, for reasons relating to your particular situation, to object to this processing.

However, it is possible that VISITWallonia may refuse your objection request by providing proof of the existence of legitimate and compelling reasons justifying the processing of your personal data.

Right to rectification

You have the right to ask VISITWallonia to correct the inaccurate information about you.

Right to restriction of processing

You have the right to obtain the restriction of processing of your Personal Data when:

  • You dispute the accuracy of your Personal Data, for a period allowing VISITWallonia to verify the accuracy of these data.
  • The processing is unlawful;
  • VISITWallonia no longer needs the personal data for the purposes of the processing but they are still necessary for you to exercise a legal right;
  • You exercise your right to object for a period allowing VISITWallonia to verify that the legitimate reasons it pursues prevail over yours.

Right to erasure

You have the right to ask VISITWallonia to erase your Personal Data if you are in one of the following cases:

  • The data are not or no longer necessary in relation to the purposes for which they were collected or otherwise processed ;
  • You withdraw your consent to the use of your data ;
  • Your data have been unlawfully processed;
  • Your data must be erased to comply with a legal obligation ;
  • You have objected to the processing of your data and there is no legitimate or compelling reason not to comply with this request.

Right to withdraw your consent

In the case of processing of your Personal Data based on your consent, this consent can be withdrawn.

Right to data portability

You also have the right to receive the Personal Data concerning you, which you have provided to VISITWallonia, in a structured, commonly used, and machine-readable format, and the right to transmit them to another data controller when the processing of Personal Data is based on your consent or a contract and carried out by automated means.

Right to lodge a complaint

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, particularly in the Member State of your habitual residence, your place of work, or the place of the alleged infringement if you consider that the processing of your Personal Data infringes the GDPR.
